User AvatarDid Activision apply for a trademark would be the first question. It can also be tough when it's a concrete concept, just think of the trouble Microsoft had to go through to make Windows their own.

User AvatarWhat's even more interesting is that such a banal title conceals two of the most unique and original titles of the whole industry.

As for subject, I think it's good that this issue wasn't brought up. The recent story with Fahrenheit/Indigo Prophecy made me think that people are incapable to think outside of labels and trademarks anymore.
